The Habitable Condition Requirement

California Civil Code 1941 requires landlords to keep rental units in a "condition fit for human habitation." This is a broad standard that courts and housing agencies have interpreted over decades. The Civil Code 1941.1 provides a specific list of what "habitable" means, including effective waterproofing, functional plumbing, adequate heating, and — critically — "premises free from dampness, and in a clean and sanitary condition."

Applied to appliances, the habitability standard generally means:

  • The refrigerator must work if one was provided with the rental. A refrigerator that doesn't cool is a genuine habitability issue — food safety is a basic need.
  • The stove and oven must work. Cooking facilities are considered essential to habitability in California courts.
